These Terms and Conditions govern access to and use of this website, as well as all inquiries, quotations, bookings, travel arrangements, transportation, tours, activities, and other services provided or arranged by Terra Indomita. By accessing this website, requesting or confirming a booking, or purchasing a service from Terra Indomita, you acknowledge that you have read, understood, and accepted these Terms & Conditions.

Definitions

For the purposes of these Terms and Conditions:

“Terra Indomita”, “we”, “us” or “our” refers to Terra Indomita and the legal entity operating under this commercial name.

“Client” means any person who requests, books, purchases, or contracts a service provided or arranged by Terra Indomita.

“Participant” or “Passenger” means any person who participates in or uses a booked service, whether or not that person made the original booking.

“Service” or “Services” includes tours, excursions, private transportation, transfers, trekking, wildlife experiences, navigations, accommodation arrangements, multi-day programs, tailor-made journeys, and any other travel-related service provided or arranged by Terra Indomita.

About Terra Indomita

Terra Indomita is a Patagonia-based boutique tour operator providing and arranging private and tailor-made travel services throughout Patagonia.

Our services may include private tours, transportation and transfers, trekking, wildlife observation, navigations, accommodation arrangements, multi-day programs, and other nature-based or travel-related experiences.

Services may be operated directly by Terra Indomita or arranged in cooperation with carefully selected independent providers.

Use of the Website

You agree to use this website lawfully and in good faith.

You must not use the website in any manner that could damage, disable, overburden, or impair its operation or interfere with another user’s access.

Informational Content

Information published on this website is provided for general informational purposes.

While Terra Indomita makes reasonable efforts to maintain accurate and current information, itineraries, schedules, prices, availability, access conditions, wildlife activity, weather, transportation schedules, park regulations, and other operational circumstances may change.

Photographs, itineraries, wildlife descriptions, journey examples, and other content presented on the website are illustrative and do not constitute a guarantee that identical conditions, sightings, routes, or experiences will occur.

The specific services included in a booking will be those stated in the corresponding written quotation or booking confirmation.

Requests, Quotations and Booking Confirmation

An inquiry, itinerary request, or quotation submitted through our website, email, WhatsApp, or another communication channel does not constitute a confirmed booking.

Unless otherwise stated in writing, quotations are subject to availability, operational conditions, and confirmation of any third-party services included.

A booking is considered confirmed only when:

* Terra Indomita has provided written confirmation; and

* the required deposit or full payment has been received within the specified deadline.

If payment is not received within the stated period, availability and quoted prices cannot be guaranteed.

Prices, Currency and Payment

Prices may vary depending on seasonality, group size, availability, service level, itinerary, transportation requirements, third-party services, and customization.

Unless expressly stated otherwise, a quotation includes only the services specifically listed in the written proposal or booking confirmation.

Payment conditions, deposit requirements, payment deadlines, and accepted payment methods will be specified in each individual proposal or booking confirmation.

Prices may be quoted in Chilean pesos (CLP), US dollars (USD), or other currencies.

Where a service is originally priced in Chilean pesos but displayed or quoted in another currency, the foreign currency amount may be approximate and subject to exchange-rate fluctuations. The final applicable price and currency will be confirmed at the time of booking.

Bank charges, international transfer fees, card processing charges, currency conversion costs, or other financial institution fees may apply depending on the payment method and will be communicated where applicable.

Cancellations by the Client

Cancellation requests must be submitted in writing.

The effective cancellation date will be the date on which Terra Indomita receives the written notice.

Cancellation charges depend on the time remaining before the scheduled service and will be detailed in our Cancellation & Refund Policy and/or the individual booking confirmation.

Certain services may become partially or fully non-refundable once confirmed. These may include, among others, park entrance tickets, navigation tickets, accommodation, permits, private transportation, specialist guides or trackers, and other prepaid third-party services.

Where a booking includes services subject to stricter supplier cancellation conditions, those conditions will be communicated before confirmation whenever applicable.

Changes Requested by the Client

Requests to modify dates, services, passenger numbers, itineraries, pickup or drop-off locations, or other elements of a confirmed booking are subject to availability and operational feasibility.

Any additional costs resulting from the requested modification will be communicated before the change is confirmed.

Changes cannot always be guaranteed, particularly when third-party services have already been reserved, issued, or paid.

Passenger and Participant Information

The Client is responsible for providing accurate, complete, and timely information necessary for the organization and safe delivery of the Services.

The Client is also responsible for ensuring that relevant information regarding all passengers or participants included in the booking is provided to Terra Indomita when required.

This may include identification information, travel dates, dietary requirements, relevant health or mobility considerations, fitness level, and any other information that could reasonably affect participation in or delivery of the Service.

Passengers and participants are responsible for ensuring that passports, visas, vaccinations, permits, insurance, and other travel requirements applicable to them are valid and in order.

Physical Requirements and Safety

Certain activities—including trekking, wildlife observation, and other outdoor experiences—may require an appropriate level of physical fitness, suitable clothing, footwear, and personal equipment.

Participants must follow safety instructions provided by guides, drivers, park authorities, and activity operators at all times.

Terra Indomita reserves the right to restrict or discontinue a participant’s involvement in an activity when, in the reasonable judgment of the guide or operator, continuing could place that person, other participants, staff, wildlife, property, or the environment at risk.

Transportation and Transfers

Clients and passengers are responsible for providing accurate pickup, drop-off, accommodation, flight, bus, or other relevant transportation information.

Passengers must be ready at the agreed pickup location at the confirmed time.

Terra Indomita will make reasonable efforts to operate transportation services according to the confirmed schedule. However, journey times may be affected by weather, road conditions, traffic, border procedures, park access, accidents, or other circumstances outside our reasonable control.

Where a transportation service is connected to a flight, navigation, bus, or other scheduled departure, the Client is responsible for providing accurate schedule information and allowing reasonable connection time.

Late Arrivals and No-Shows

Passengers and participants must be present at the agreed meeting or pickup point at the confirmed time.

Failure to appear for a confirmed Service without prior notice may be considered a no-show, and the Service may be treated as non-refundable.

If a passenger or participant is delayed, Terra Indomita will make reasonable efforts to accommodate the situation where operationally possible.

However, activities, transportation schedules, navigation departures, park schedules, and other time-sensitive services may not be able to wait for late passengers.

Any additional costs resulting from a delay attributable to the Client, passenger, or participant may be charged accordingly.

Travel Insurance

Terra Indomita strongly recommends that all Clients and participants obtain comprehensive travel insurance appropriate for the Services included in their itinerary.

Travel insurance should ideally cover trip cancellation or interruption, medical expenses, accidents, emergency evacuation, baggage loss, transportation disruption, and other unforeseen circumstances.

For certain expeditions or activities, specific insurance coverage may be required and will be communicated before booking.

Third-Party Services

Terra Indomita may arrange or include services provided by independent third parties, including navigation companies, accommodation providers, transportation operators, guides, park authorities, estancias, restaurants, and other activity providers.

These services may be subject to their own operating rules, schedules, cancellation policies, and terms.

Terra Indomita will make reasonable efforts to coordinate and manage these services as part of the Client’s itinerary but cannot guarantee circumstances outside our reasonable control.

Nothing in these Terms excludes or limits any responsibility that cannot legally be excluded under applicable law.

Wildlife, Weather and Natural Conditions

Patagonia is a wild and dynamic environment. Many Services depend on natural conditions that cannot be controlled or predicted.

Wildlife sightings, including pumas and other species, are never guaranteed.

Weather, wind, visibility, road conditions, trail conditions, navigation schedules, park access, wildlife activity, governmental restrictions, and safety considerations may require changes to the planned itinerary.

The absence of a particular wildlife sighting does not constitute grounds for a refund when the contracted guiding or tracking service has been provided.

Operational and Safety Changes

Terra Indomita and its guides or operators reserve the right to modify the route, schedule, sequence of activities, departure time, duration, transportation arrangements, or itinerary when reasonably necessary due to safety, weather, road conditions, park restrictions, environmental considerations, supplier operations, or other circumstances affecting the safe or responsible delivery of the Service.

Where reasonably possible, Terra Indomita will seek to provide an appropriate alternative of comparable nature or value.

Safety decisions made by guides, drivers, park authorities, or operators during a Service must be respected.

Force Majeure and Events Beyond Our Control

Terra Indomita shall not be responsible for delays, modifications, interruptions, or cancellations caused by events beyond our reasonable control.

These may include severe weather, natural events, wildfires, strikes, governmental actions, border restrictions, road closures, park closures, transportation disruptions, public emergencies, or other extraordinary circumstances.

Where such circumstances affect a confirmed Service, Terra Indomita will make reasonable efforts, depending on the circumstances, to offer an alternative arrangement, rescheduling, travel credit, or refund of amounts that are recoverable.

Any non-refundable amounts already paid to third-party suppliers may be deducted where permitted by applicable law.

Limitation of Liability

To the fullest extent permitted by applicable law, Terra Indomita shall not be liable for indirect, incidental, special, or consequential losses resulting from circumstances outside our reasonable control.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law or mandatory consumer protection regulations.

Intellectual Property

Unless otherwise stated, all content published on this website—including text, photography, graphics, logos, branding, design elements, and layout—is owned by or licensed to Terra Indomita.

No content may be reproduced, distributed, modified, published, or used commercially without prior written authorization.

Privacy

Personal information provided through our website, email, messaging services, booking process, or other communication channels will be handled in accordance with our Privacy Policy and applicable law.

Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Chile, without prejudice to any mandatory consumer protection rights or other rights that may apply to the Client.
